Akunin’s Winter Queen is a novel written at the very end of the twentieth century but it is about the nineteenth century. Please compare it with the “true” nineteenth-century crime fiction works (in particular Crime and Punishment) we read in terms of how he handles the work of the detectives, the nature of crimes in the nineteenth century, and the role women play.

The large purpose of Sheinin’s Diary of a Criminologist is to evoke trust that you, as readers, should feel when he, a prosecutor, tells you what’s right and what’s wrong in terms of the law and one’s social behavior. Is he successful in establishing this trust with you?

The FAR and Contract Provisions for Protection

Imagine that you are a contracts officer for the Internal Revenue Services (IRS), and that your supervisor has tasked you with the procurement of a new software system for processing tax returns. You have recognized that contract administration involves those activities performed by government officials after they award a contract. Once an award is made, contractors receive the contract, which includes provisions to minimize the risk and define rights and obligations, from the Internal Revenue Service.

Review Federal Acquisition Review (FAR) “52.246-1 Contractor Inspection Requirements”.

Write a two to three (2-3) page paper in which you:

Evaluate the importance of the standard default clause. As a contracts officer for the IRS, suggest two (2) ways in which you could combine the standard default clause with the FAR’s delay provision for the protection of both parties to the contract.

Speculate on the impact that a contracting officer’s changes to the payment terms within the software contract would exert upon both the government and the contractor. Analyze the requirements for a contracts officer to successfully effectuate a change order on behalf of the government. Conclude whether or not the change order is the most secure method for making a contractual change. Justify your response.

Examine the inspection criteria that FAR 52.246-1 articulates, and discuss the necessity of each requirement. As a contracts officer for the IRS, suggest two (2) improvements that you could make to the inspection procedure in order to make the procedure more efficient.

Nabokov’s Despair is a novel written from the criminal’s point of view. What, in your opinion, are advantages and disadvantages of the first-person narrative in crime fiction? 2. In the “Leadership Snapshot” of Humaira Bachal, Northouse cites this kind of conflict as an example of Content Conflict/Regarding Goals/Substantive Conflict. What other classifications in his categories of different kinds of conflict might also help explain what accounts for the virulent differences in her experience? Why?

Media Law UK-Children/Sex Offences

McNae’s Essential Law for Journalists (22nd edition) is recommended to use to answer the following questions. Please only apply UK media law to answer the questions.

Give detailed answers to the following questions:

1) New criminal behaviour orders are being introduced which could be imposed on juveniles who have been convicted of an offence. What is the situation with regard to naming a young person when such an order is imposed? Can they be named if they are charged with breaching an order of this type? Explain the law.

2) As proceedings in youth court are about to start, the presiding magistrate tells the only reporter present to leave the court as the press are “not allowed to attend”. Is she right? What would you tell the bench?

Later, the reporter asks for the name of the presiding magistrate, but the clerk of the court says it is not the court’s policy to give names of the justices to the press. Is he right to refuse the name? What would you tell the court?

3) A man is remanded in custody charged with the unlawful killing of his girlfriend’s 18-month-old daughter. The chairman of the magistrates says: “we are making an order under section 39 of the children and young persons act that nothing should be published that would identify the child. We do so to preserve the anonymity of other children in the household even though they have no connection with the circumstances of the alleged offences” Is such an order valid? What view has been expressed by High Court Judges? What action would you take if you were sitting on the press bench when this order was made?

4) A publican is accused of sexually assaulting his teenage niece while she was working behind his bar. Explain how you would report the trial to avoid any legal or ethical problems.

In a separate case, police have arrested a number of men for kerb-crawling. When they appear in court, will you be able to name them? Explain your reasoning.
