Ethical Decisions in the Workplace
After reading your background readings, please review the following scenario and address the questions at the end.
Jerry Stevens heads up an excavation crew for the municipal utilities district in a city in Nebraska. A sewer line needs to be replaced and it has

been excavated with a back-hoe. The trench is 7 feet deep. The municipality’s safety rules indicate that employees should not go into the trench

without a trench box. This rule is to prevent employees from being buried if the trench walls collapse. People die every year from trench cave-ins.
The trench box won’t arrive on site for another 6 hours and the city promised residents that the sewer would be fixed by the end of the day, which

now seems impossible. The City Administrator called Jerry on his cell phone and indicated that it was imperative that the sewer be fixed as soon as

conceivably possible because a City Council member is served by that sewer line and will raise a fuss if it’s not fixed by the promised time.
One of the more experienced workers states, “It’s only going to take 30 minutes to dig under the pipe and loosen the fittings. We don’t need the

trench box. We used to do this all the time before we were required to use one of those darn things.”
Jerry knows he’s right. He used to do it himself before the rule was put in place. Also, the soil is clearly a cohesive soil and it’s highly

unlikely that it will collapse. And although there is an organizational policy to use a trench box for trenches deeper than 5 feet, the Occupational

Safety and Health Administration (OSHA) does not have
Jurisdiction over municipalities in Nebraska because municipalities are political subdivisions of the State. The only entity regulating safety

policies is the City’s Safety Director and he took the day off.
1. In this scenario, to what extent do you think allowing the crew into the trench without a trench box would be pushing (or exceeding) the limit?

Case Study 1: Janice
Janice is a 54-year old woman who has been referred to outpatient services after relapsing. She had previously been abstinent from crack

cocaine and alcohol for 20 years; however, after the death of her mother and partner, she began to drink again. Initially, she was able to

manage her alcohol use but it quickly escalated from “a drink or two” after work to a bottle of vodka every two days and a drink in the

morning to “calm her nerves” before work. She has not returned to the use of crack but is still drinking daily and there is alcohol on her

breath during this initial visit.

She is no longer able to visit her grandson because of her alcohol use and is in danger of losing her home because of missed mortgage

payments. She states that she is incredibly depressed and grief stricken over the loss of her mother and partner and was mandated to OP by

her employer. Further, she recently suffered a broken wrist during aa alcohol related blackout (period of amnesia), which she never sought

medical treatment for and awoke one morning to see that her car had been damaged but has no memory of getting in an accident. She now

smokes about a half of a pack of cigarettes a day, which she started using again after 10 years of tobacco abstinence.

Case Study 2: John
John, a 42-year-old was recently referred to an outpatient clinic after becoming dependent on pain medications prescribed after a hip

replacement, which was performed 18 months ago. His pain was managed by his orthopedist, originally with oxycodone and more recently with

ibuprofen, however, he insists that the ibuprofen is not sufficient to manage his pain and has begun to “doctor shop”. Recent extensive

reevaluation of his hip pain was negative.

He requested that his orthopedist prescribe something stronger like “oxys” for his pain, as the ibuprofen was ineffective. He was told to

discuss his pain management with his primary care physician. He’s been on disability since his hip surgery and lives with his wife and two

children. He denies current or past alcohol, tobacco, or drug use. While he does not admit it, his mood appears low, his facial expression

seems flat, and he has a history of mild to moderate anxiety.

Currently, he’s on ibuprofen 800 mg three times per day. He walks with a limp and uses a cane. His vitals are normal. He’s 6 feet tall and

weighs 230 pounds. He has a large, well-healed scar over the left lateral thigh and hip area with no tenderness or warmth over the hip. He

has full range of motion. He doesn’t want to return to his orthopedist, because “he doesn’t believe that I’m still in pain.

Case Study 3: Jeff
Jeff is a 30-year-old man who is being admitted to inpatient services due to his addiction to crack cocaine, methamphetamine and alcohol.

He was sent to you from the hospital, where he spent several weeks recovering from a brain injury; he had gone out to buy crack when he was

assaulted and left badly injured in an alley. He has strong family support; however, he has also been diagnosed with HIV and Hepatitis C,

which he thinks he contracted by “hooking up” with men at crystal meth parties. He is healing well from the surgery but has trouble keeping

his balance when standing and is unable to recall many of the events from the night of the attack. He has not been compliant with his HIV

medications and denies that his drug use is a problem. During his hospital stay, he had a friend sneak powdered methamphetamine and alcohol

into his room on several occasions.

Although Jeff had been drinking heavily for several years, his crack cocaine and methamphetamine use began five years ago after the suicide

of “the love of his life”. He woke up one morning to find that his girlfriend had hung herself in the guest bedroom and is convinced that

she gave him a Xanax the night prior to “knock him out” so he could not interfere with her plans. He has talked to his parents about the

incident but refuses to attend therapy.

Historical Essay
As depression struck the new nation in the mid-1780s, new questions arose about the nature of American democracy. Many conservatives believed that the

answer lay in a stronger national government. Most radicals believed it was up to the states to relieve the financial burden of the people. These

sentiments fostered a movement for a new constitution. Political differences soon stimulated the creation of political parties.

Compare and contrast the Articles of Confederation with the new Constitution of 1787. What were the strengths and weaknesses of the Articles vis-à-vis

the Constitution? Give specific instances that demonstrate the weakness of the Articles (such as the Western problem).

Then analyze the drafting of the Constitution, using specific details to show how the various states (slave vs. free, east vs. west) compromised in

order to effectively draft a constitution. Pay particular attention to Roger Sherman’s plan, the Great Compromise, which broke a stalemate that could

have been fatal to the development of the new Constitution.

Finally, compare and contrast the debate over ratification between the Federalists and the Anti-Federalists. Make sure you cite specific examples from

the Federalist Papers to support the Federalist position and contrast it with leading proponents of the opposition (such as John Hancock). Analyze how

the debate over a bill of rights illustrates the differences between the two parties. Evaluate the relative success of the Bill of Rights in achieving

an effective balance between national and states’ interests.

Drafting of the constitution began in 1787, it was important because it had influenced to bring up and strengthen the Federal government. Since the

Already established Articles of Confederation was failing miserably. Once the bill of right was proposed in 1789, by popular demand the convention was

called for in 1790 by the Convention. Without this ratification then there wouldn’t be United States of America. Since the Articles were not good

enough and without the ratification the the constitution would not have gone into effect. Number of important men in history played a significant hand

in this process, and for some it was a more difficult decision then others. To come together and create such a perfect document took patients and lots

of understanding and acceptance.

 

A Just Society

Over the course of the semester we are given serious consideration to various ethical theories and how they help us to understand some ethical issues we encounter in our daily lives. Thinking more broadly, a well-considered theoretical basis is essential for a moral society, something we call the Just Society. The concept of a Just Society is perhaps simple in conceptualization: how should people behave in order for a given society to be considered as fair as possible to all members of that society? In order for us to determine proper behavior, we of course must have some way to measure that behavior, and that ‘some way’ is one of the ethical theories we’ve taken
up this semester. So for the final essay I’d like you to discuss what the Just Society appears like to you. To explain and support your vision you should deal, in depth, with the following questions: how shall people
treat each other? How shall we judge proper (i.e. ethical) behavior? What specific issue or two can you provide to very specifically illustrate how humans will behave ethically? The last question allows you opportunity to (i.e. you must) bring in at least one, though two is better and more is yet better still,, applied topics to your essay. Finally, what behavioral standard would illustrate an unjust society? Your essay should be at least six full pages in length, double-spaced, 12-point font and 1-inch
