Answer TWO of the following 4 questions. Each question carries equal marks.

QUESTION 1

Tina and Martin are both employed in the personnel department of Financial

Services Ltd as personnel assistants. They both started working for the company

at the same time but after five years Martin is paid more than Tina even though

they work for the same number of hours. Also Martin receives more days holiday

per year than Tina. Tina is arguing that she should receive the same pay and

holiday as Martin.

Susan is employed in the secretarial department. She has discovered that her

pay (and that of other secretarial staff) is about half of that received by staff in the

marketing department, all of whose members are male. She has complained that

this difference in pay amounts to sex discrimination and that she should be paid

the same salary as the marketing staff.

Rachel works part-time in the personnel department. Most of the staff employed

part-time in the department are female. Rachel has complained that part-time

staff are excluded from the company’s sick pay and occupational pension

schemes. She complained about this but was told that it was too costly and

therefore not financially viable to include part time staff in the schemes. Rachel

is arguing that this exclusion amounts to sex discrimination.

Rita and Tom both applied for a job in the sales department. They were both

equally qualified and experienced but the job was offered to Tom. Rita was told

“the sales job requires long hours and a lot of stamina, we do not think it is a job

for a woman”.

Rita is arguing that she has been a victim of sex discrimination.

Advise Tina, Susan, Rachel and Rita on the basis whereby EU law on sex

discrimination (Art 157 TFEU) can be argued to the above events and critically

assess whether each could be successful in actions against the company for sex

discrimination

QUESTION 2

Pueblo is a Spanish farmer of sheep and dairy cattle. There was an outbreak of

sheep rot in some EU member states, although Pueblo’s farm was not affected. As

a result of this disease, trade in live sheep was restricted in the EU although an all

clear was recently announced. When Pueblo attempted to import some live sheep

into France the French authorities required him to pay for a health inspection.

Pueblo exported milk to the UK. At the port of arrival he was required to pay a fee

for storage and checking. He then paid a further amount for onward transportation.

Pueblo’s farm also produces different types of cheese. He imports some high

quality cheese to Germany. The German authorities levy a 20% tax rate on

Pueblo’s cheeses compared to a 10% tax on equivalent German cheeses. The

authorities argue that this is justified as German cheeses are produced by

environmentally friendly methods.

Pueblo discovered that alternatives to cheese (such as cold meat and food

spreads) have only a 5% tax levied on them in Germany. Pueblo is arguing that this

is affecting the sales of his cheeses in Germany.

Critically discuss and advise Pueblo as to how the law on the free movement of

goods (as applied by Articles 30 and 110 TFEU) can be argued to the various

payments and taxes levied in the above scenario.

Critically analyse the extent to which conduct by undertakings that may affect

competition is regulated by Article 101 TFEU.

Your answer should include specific case examples and evidence of background

reading.

QUESTION 4

Brewmaster plc is a company based in the UK that produces beers and soft

drinks. It has recently experienced the following issues in relation to trading its

products within the EU:

(a) Belgium requires that beers sold within the country comply with Belgian

labelling rules. All Belgian beers comply with this, but Brewmaster’s beers do not.

Brewmaster argue that this is unfair as it would be too costly to label their beers

differently for Belgium. Belgium also requires that the labelling states a health

warning. Brewmaster’s beers do not include this. As a result of these

requirements Brewmaster are prevented from selling their beers in Belgium.

(b) Bewmaster would like to sell its soft drinks in Germany. The German

authorities state that Bremaster’s soft drinks contain additives which are

prohibited in Germany which has banned all imports that contain the additives.

Bewmaster argue that their soft drinks are accepted elsewhere in the EU and

therefore should be accepted in Germany.

(c) Recently, due to high alcohol consumption in Sweden the Swedish authorities

have introduced a law that restricts the advertising of alcoholic drinks. This has

made it more difficult for Brewmaster to promote their beers in Sweden causing

them to lose market share in favour of national brewers.

Critically discuss how EU law on the free movement of goods (as applied by

Articles 34 and 36 TFEU and relevant case law) can be applied to the above

events and advise Brewmaster on whether the restrictions they have

encountered are likely to be in breach of EU Law.

To what extent do you agree that security management is the most important, yet most undervalued function in most modern organisations? Use theory, evidence and examples to support your answer.
You can decide how best to approach the essay topic. For example, you may decide to focus on security management in one particular industry/sector (e.g., healthcare, energy, retail, etc.), and/or you may decide to concentrate solely on specific types of security threats (e.g., cybercrime, terrorism, etc.).
You can also decide how best to structure your essay. For example, you may wish to create sections with headings (e.g., ‘The importance of security management’, ‘Understanding how security management is valued’, etc.) or you may prefer to stick to a more traditional essay format by using a continuous dialect.
Whatever approach and structure you choose, you must ensure that:
 Your essay directly answers the essay question, and
 The first/introductory paragraph of your essay clearly explains how you will approach and
structure your response to the essay question, and
 The last paragraph summarises your findings and conclusions.
Some general advice for the essay:
 Develop your answer based on the information you have gathered from a range of sources –
do not just rely on the information contained in one or two sources.
 Ensure that you demonstrate that your understanding of the topic has developed beyond
the information contained in the lecture slides.

 Where appropriate, try to be both critical and comparative of the sources that you cite.
 When arriving at conclusions, make sure that it is clear how your conclusions (i.e., your

 Be clear and accurate in your writing style (asking a friend or peer to proof-read your essay
prior to submission may prove valuable)

Report Brief and Criteria (800 words)

Imagine you have been appointed as a consultant to an organisation which needs to adapt to the 21st Century VUCA environment.
To assist the organisation write a report which:
a) Includes a cover page, executive summary and table of contents.
b) Introduces the importance of organisations adapting to the VUCA environment.
c) Critically analyses how effective leadership may support organisational success.
d) Concludes by proposing a generic action plan for organisations to adapt to the VUCA environment.
e) Cites academic sources in the body of the text and lists them in the reference list at the end of the report.

Reflective Essay Brief and Criteria (200 words)

In the 21st Century, organisations need to adapt to the VUCA environment. Reflect on your capability as a new graduate employee to demonstrate effective leadership to support your employer as it adapts to the VUCA environment.
Write a reflective essay which:
a) Clearly draws on and refers to your current leadership capabilities (both strengths and areas for development) as reflected on during activities from throughout the academic year.
b) Clearly sets your capabilities against organisational requirements for success.
c) Proposes feasible actions you can take now to develop your leadership capability to support organisational adaptation to the VUCA environment.
d) Cites academic sources in the body of the appendix and lists them in the reference list at the end of the report.

Assessment 2 Further Guidance

Report
• The cover page, executive summary and table of contents are NOT included in the word count, but MUST be included in the report.
• It is recommended that your report include a short introductory paragraph which introduces the topic and outlines the report structure.
• It is recommended that you critically discuss ONE opportunity and ONE challenge in relation to your chosen topic. (n.b., you will have developed an understanding of the opportunities and challenges through participation in class time during the “leaders and teams” activity).
• It is REQUIRED that you refer to TWO theoretical approaches to leadership, at least ONE of which MUST be drawn from the four topics covered in TB2 TW2 & TW3. The OTHER approach may be chosen from among ALL leadership topics covered throughout the academic year.
• It is recommended that you briefly integrate and cite ideas appropriately from the guest change and decision making lectures (TB2 TW1 & TW4).
• It is recommended that the conclusion (i.e., the action plan) proposes TWO distinct and feasible actions which clearly derive from your discussion and which are discussed in detail.
• It is recommended that you cite a minimum of EIGHT appropriate and different academic sources in the body of the text (n.b., cited references should be listed in a reference list at the end of the report).
• The reference list is NOT included in the word count, but the in-text citations ARE included in the word count.

Reflective Essay

• It is REQUIRED that you limit your discussion to the area of your chosen topic only. The choice of topics, noted in the brief above, is, once again:
i. Encourage creativity and innovation in a team you belong to; OR
ii. Support new strategic imperatives such as equality, diversity and inclusion or sustainability; OR
iii. Rework organisational design for VUCA environments.
• It is recommended that you cite a minimum of TWO appropriate and different academic sources in the body of the text (n.b., cited references should be listed in a reference list at the end of the report).
• Label the reflective essay “Appendix 1”. Further headings are NOT required, nor are they useful in this instance.

Assessment 2 Grading Guidance

When considered together, the report including the reflective essay, will be awarded grades as follow:

To gain a Distinction, ALL elements of the brief must be included and MOST will be addressed to at least a very good standard. (n.b. Marks between 75-85% will similarly be awarded to work which is at least excellent. Likewise marks between 85- 100% will be awarded to work which is at least outstanding). It will include a strong critical discussion.

Distinction level work is focused and clearly organised, and it shows depth of development including strong critical discussion. The language is precise and shows syntactic variety, and ideas are clearly communicated to the reader.

Asthma

 
Complications of asthma can be sudden. Consider the case of Bradley Wilson, a young boy who had several medical conditions. He appeared in good health when he went to school, returned home, and ate dinner. However, when he later went outside to play, he came back inside wheezing. An ambulance took him to the hospital where he was pronounced dead (Briscoe, 2012). In another case, 10-year-old Dynasty Reese, who had mild asthma, woke up in the middle of the night and ran to her grandfather’s bedroom to tell him she couldn’t breathe. By the time paramedics arrived, she had passed out and was pronounced dead at the hospital (Glissman, 2012). These situations continue to outline the importance of recognizing symptoms of asthma and providing immediate treatment, as well as distinguishing minor symptoms from serious, life-threatening symptoms. Since these symptoms and attacks are often induced by a trigger, as an advanced practice nurse, you must be able to help patients identify their triggers and recommend appropriate treatment options. For this reason, you need to understand the pathophysiological mechanisms of chronic asthma and acute asthma exacerbation.
To prepare:
Review “Asthma” in Chapter 26 of the Huether and McCance text. Identify the pathophysiological mechanisms of chronic asthma and acute asthma exacerbation. Consider how these disorders are similar and different.
Select a patient factor different from the one you selected in this week’s Discussion: genetics, gender, ethnicity, age, or behavior. Think about how the factor you selected might impact the pathophysiology of both disorders. Reflect on how you would diagnose and prescribe treatment of these disorders for a patient based on the factor you selected.
Review the “Mind maps—Dementia, Endocarditis, and Gastro-oesophageal Reflux Disease (GERD)” media in the Week 2 Learning Resources. Use the examples in the media as a guide to construct two mind maps—one for chronic asthma and one for acute asthma exacerbation. Consider the epidemiology and clinical presentation of both chronic asthma and acute asthma exacerbation.

Informatics and Evidence Based Practice

 

 
You are consulting with the education and practice development team in a large tertiary care hospital serving a region comprising mostly rural communities. The team is responsible for strengthening the implementation of evidence-based practice based on outcomes. Over the next 2 years, it must set performance objectives to (1) strengthen screening for pain, depression, and adverse health behaviors (smoking, excess alcohol intake, and body mass index [BMI] greater than 30) at intake for all adult admissions; (2) implement comprehensive geriatric assessment for all those over age 65 hospitalized for more than 7 days or readmitted within less than 3 days following discharge; and (3) promote care team performance.

The hospital has 200 adult admissions each week and has implemented a fully electronic health record. Guideline dissemination generally occurs through educational venues or via the electronic policy and procedure manual. The method of documentation for narrative notes is documentation by exception using SOAP (subjective, objective, assessment, and plan) and the hospital has also made extensive use of checklists to complement the documentation system.
Discussion Questions

1. Using clinical guidelines and standards of care, identify what data elements should be included in the EHR assessment and evaluation screens if these goals are to be achieved.
2. Identify how information system defaults and alerts could be used to achieve these goals.
3. Once screening has been improved, what are the next steps in improving patient outcomes?
4. How could the EHR be designed to support these outcome-related goals?

Assignment requires you to submit a reflective essay addressing the following questions:

How do you currently lead?
What are the core principles that underlie your approach to leadership?
In light of the ideas presented in this course, how will you lead in the future?
What kind of leader do you want to be?
What do you want to make sure you keep doing?

Apply at least six (6) concepts from the textbook and any other concepts that shape how you will practise leadership now and in the future. However, your essay must represent a coherent whole rather than a listing of various attributes that describe your approach.

This paper will be evaluated using an adaptation of the “Critical Thinking Rubric” created by the Critical Thinking Project at Washington State University and will be assessed on overall presentation and the following four areas:

Does your paper reflect your own perspective and position? (e.g., are you clearly writing about your approach and not simply describing someone else’s)
Do you identify and assess the key assumptions that underlie your perspective and position? (e.g., do you talk about how you arrived at your theory or do you simply state your conclusions?)

The assessment for Classroom Observation is split into two parts. In the first, you are asked to discuss approaches to grammar teaching; the second part gives you more freedom, and is based upon your observation of a video or of several videos. Both answers ought to contain a coherent blend of theoretical discussion and analysis of data.

Discussion of Approaches to Grammar Teaching

Using published sources to help you, explain and critically compare some current approaches to teaching grammar in the ESOL classroom. Your discussion must include an assessment of task-based learning (TBL), and you should also refer to PPP. If space permits you may wish to extend the discussion to other models you read about.

In the course of your essay, you must refer to the lesson ‘Part One Video: He’s been to Turkey’ (on VITAL, under Assessment) and decide which approach to grammar teaching the teacher seems to have adopted. Please also evaluate the lesson, suggesting possible improvements or alternative approaches. If you wish, you can find another example from a published coursebook that provides a contrast with this teacher’s approach, and compare them. (Any coursebook pages you refer to in your assignment should be scanned as an appendix at the back of your assignment.)
