International Law

10
International Law
?The inescapable fact is that the world is today organized on the basis of the coexistence of states, and that fundamental changes will only take place through state action??
Philip C. Jessup, A Modern Law of Nations (1948) Macmillan Co.
How relevant is Jessup?s analysis of international law today in light of the recent proliferation of non-state actors in international relations?

Please note that this written assessment requires you to write a Research Paper. Accordingly:
1. Your Research Paper should be correctly footnoted in accordance with the Australian Guide to Legal Citation 3rd edition (AGLC) and must also contain a bibliography listing the sources which were cited in the Research Paper as well as those sources which were of general assistance to you in writing the Research Paper.
2. Correct use of grammar, spelling and punctuation are of paramount importance.
3. This is also a fairly broad research topic (for which there is more than ample research material available) and your primary challenge will be to prioritise and synthesise key examples and relevant sources of international law which directly address this question.
4. Your Research Paper should include a comparative analysis of the roles of state and non-state actors as recognised by international law with a view to making an assessment of the relevance of Jessup?s statement today. The Research Paper is not intended to elicit a response focused on international relations and politics but instead requires a sustained analysis of the topic in the context of the body of relevant international law.
5. Most importantly, write your Research Paper in a concise and analytical manner which seeks to arrive at a conclusion with respect to the particular question and the issues it raises. An effective methodology in approaching this relatively broad question may involve examining the general issues raised by the question through particular subcomponents of international law (e.g. international human rights law or international criminal law) and the use of specific examples from the operation and development of international law in the latter 20th and early 21st Centuries.

Domestic Terrorism and Extremism Groups

Domestic Terrorism and Extremism Groups

Subject:

Law

The growth of Christian Identity and non-Christian political religious groups has been a direct attack on traditional religious organizations. Traditional religious organizations teach brotherhood and love of your neighbor, but both Christian Identity and non-Christian political religions reject this kind of teaching. They are churches of hate and white supremacy. For this week’s discussion topic, you are to examine the Christian Identity movement and describe how these churches have concocted their beliefs from their mystical readings and interpretations of the Bible. In other words, how do these extremists use the Bible as justification for their theology of hate? Also, you are to examine how these groups define their “ideal government.” In other words what might their established theocracy resemble? What would be some of its tenets and beliefs?

*THIS IS THE ESSAY QUESTIONS:
QUESTION

Business Education Ltd is a Perth based company that retails textbook worldwide. Maria is their Purchasing Manager and Charles is their Chief Accountant.
Business Education Ltd has a constitution with only the following two clauses:
(i) An objects clause restricting its activities to the “international sales and distribution of written textbooks used for educational purposes”.
(ii) A clause requiring “purchases exceeding $1million must be approved by the Board of Directors of the company”.
Maria visits publishers in Sydney. She enters into discussion with Asia Books Pty Ltd, a company based in Sydney that has exclusive distribution rights in the Asia and Pacific region for a very popular series of fiction books that can be downloaded on iPads. Maria signs an agreement for Business Education Ltd to be the Australian distributor of fiction books for the next 5 years.
When the Managing Director of Business Education Ltd learns of this transaction, he corresponds with Asia Books Pty Ltd rejecting the agreement on the grounds that Business Education Ltd has no legal capacity to enter into such a contract and the company is bound to follow its constitution through the statutory contract under the Corporations Act.
Charles attends an accountant’s conference in Tasmania when he happens to become aware of a warehouse, suitable for storing the company’s educational textbooks. He visits the warehouse owner, introduces himself as chief accountant and signs a contract on behalf of Business Education Ltd to lease the warehouse for 3 years for 1,200,000.
Upon learning of Charles’s actions, the Managing Director of Business Education Ltd refuses to accept the lease. He corresponds with the warehouse owner denying any liability under the lease on behalf of Business Education Ltd, pointing out:
(i) That Charles did not have the authority to sign an agreement of that type; and
(ii) That Charles exceeded his spending limit.

REQUIRED:
Answer all questions. Each of the three parts must be answered separately. Refer to the Corporations Act and case law where possible in answering the questions.
a) With reference to the Corporations Act state five legal differences between Business Education Ltd and Asia Books Pty Ltd.

b) Taking into consideration the Managing Directors correspondence with Asia Books Pty Ltd, advice Asia Books Pty Ltd of its rights.

c) Advise the Tasmanian warehouse owner of his rights. Your answer should include consideration of items (i) and (ii) of the Managing Director’s correspondence to the warehouse owner.
Note: You are not required to discuss legal issues arising under the Law of Contract. You also do not have to consider whether the directors have breached their duties when answering this question.

Valentine Shortis Verdict Paper

Valentine Shortis Verdict Paper

Subject: Law
Description

The first assignment will be a 1200-word essay (approximately 4 double-spaced typed pages) that requires you to read the first seven chapters of Martin Friedland’s The Case of Valentine Shortis. This part of the book deals with the arrival of Valentine Shortis to Canada, his perpetration of a bungled hold-up attempt, his arrest for the murder of two payroll clerks, and his subsequent trial in Valleyfield, Quebec. You will be asked to imagine yourself as a member of the jury and determine to the best of the evidence presented whether you would have found Shortis sane (and therefore guilty) or insane (and therefore not guilty). There was no question that Shortis actually committed the crimes, so make sure that you focus exclusively on his mental state during the robbery rather than larger questions of guilt. Similarly, please make sure that your argument is derived only from the evidence presented in court and that you use the legal definition of insanity that was on the books during the 1890s (contemporary ideas on insanity and mental illness should not be used). Your essay will be graded based on how well it is organized and structured; the strength of your arguments; your basic understanding of the material; and the quality of your writing.
