Legal Environment of Business

Citation of Case: Brady v. Criswell Funeral Homes, Inc., 916 P.2d 269 (1996).
Facts: On March 14, 1993, Mary D. Brady, the Appellant in this case, suffered the loss of her mother. Her mother was killed in a house

fire. The following day, Appellant’s brother made application and filed it with the state medical examiner’s office to have the Mother’s

remains cremated. The arrangements were made with Appellee, Criswell Funeral Home, Inc. Appellant’s brother swore on the cremation

application that he was the person having the legal authority to dispose of the bodily remains. In fact, there were three children of the

same degree of kinship. According to the statutes, each child did have the legal authority to dispose of the body.
On March 15, 1993, Appellant called the Appellee’s business and spoke with Mr. Stittsworth, an employee. She told Mr. Stittsworth she

wanted the cremation stopped. Stittsworth told Appellant that he would stop the cremation. However, the cremation was carried out on

March 16, 1993. Appellant sued Appellee for negligence and intentional and/or negligent infliction of emotional distress. Appellee argues

it carried out the cremation as requested by an authorized individual.
Issue #1: Did the funeral home have the proper authority to carry out the cremation?
Issue #2: Did the funeral home act in a reasonable manner after Appellant advised Appellee that she did not agree with the

cremation?
Decision: Yes/No
Reason Issue #1: There is no question that Appellant’s brother was a proper party to arrange for the cremation of the mother’s

body. The statutes do not require consent from every next of kin when a disposition of the body is chosen. It would be impractical to

require a funeral home to investigate the family of the deceased to determine the next of kin, find those people, and obtain their consent

to the requested disposition.
Reason Issue #2: Once the funeral home was made aware of a dispute about how to dispose of the body, it then had a duty to stop the

cremation if possible.

Stock trading program

In this assignment, you will be setting up a menu system for your project by creating code based on the associated elements from your

original pseudocode/flowchart created in Module 1. The menu system will help you see where your program is going and what modules you may

need to end up coding.

For this deliverable, we are going to be creating the menu(s) for the project so the user can navigate through the program. Think about how

your program is going to look and go back and look at your pseudocode and/or flowchart from Module 1.

Your menu(s) process(es) should reflect what you have documented in your pseudocode or flowchart

Menu should be based on a stock-tracking program under construction for client, Stock Market Trading. The GUI (Graphical User Interface)

application allows users to track their own customized account list of stock holdings. As the GUI will change over time, a program must be

available that will provide database access independent of the GUI

Module 1 Discussion
Using the NAEYC Code of Ethics (Links to an external site.)Links to an external site. (Appendix A in your text) and the Code of Ethics and Standard

Practices for Texas Educators to support your ideas, discuss the ethical way to solve the tough problem described below. To receive full points for this

discussion topic, you should post a thorough response to the topic which includes citing at least 2 principles from the NAEYC Code of Ethics and at least 1

principle from the Texas Code of Ethics (see link above) to support your views.
It happens anywhere you find toddlers. Inevitably, you will have to tell a parent that her child has been bitten by another child. This time, it’s on the

face. It broke the skin, and it’s the fourth time this week! The parent is furious. She demands to know if it is the same child who has bitten each time

and exactly who is doing the biting. Your center’s policy is not to discuss a child’s behavior and development with other children’s parents. The parent

thinks that’s ridiculous, and, besides, she thinks she already knows who did it.
Parents’ viewpoint: The parents are very concerned about their child’s safety and emotional well-being. They are especially upset because they see no

improvement in the situation. They believe that the other child’s parents should control him or her better—or leave the center. “Why should the well-

behaved children suffer?” they ask. It is not easy to believe, they feel, that the director really respects parents’ rights, from the way everyone handled

this serious safety matter.
Teacher’s viewpoint: The teacher is frustrated. For weeks now he has been working with the biter’s parents and with other teachers to control the biting.

There is no easy answer, but everyone seems to turn to him to solve this problem. He feels blamed, belittled, and unappreciated. And, to make matters

worse, he isn’t 100% certain that the complaining parents are wrong.
Director’s viewpoint: The director understands how upsetting biting is for everyone—the biter, the bitten, and their families. She firmly believes that the

center is responsible for managing behavior in the group. However, it is also important to partner with all parents. While there is no totally satisfactory

solution, teachers and both sets of parents must work as a team if there is to be any progress. The director believes that her job is to uphold the policy

of child and family privacy, while promoting home-center partnerships. (This excerpt is taken from Using NAEYC’s Code of Ethics in Young Children, January,

1997, p. 54.)

Personal Statement

Describe an example of your leadership experience.
I have a group presentation project in my history class. I am
working with three boys that I do not really know. They
choose me to be the leader of the project. Our teacher assign
us to research information and take notes. My group
members are not sure what to do. I’m shocked that they
didn’t have the responsibility for the project, because they
are trying to make me do all the work. I think each person in
our group has to be the part of it, so I try to communicate
with them and explain to them what they have to do. You
cannot be lazy when you are the member of a group, it is
important to improve our experience of working with
someone new. Luckily my group members understand it and
we get a good accomplishment in the end.
2. Every person has a creative side, and it can be
expressed in many ways: problem solving, original and
innovative thinking, and artistically, to name a few.
Describe how you express your creative side.
Drawing
Designing
Painting
I’ve learned colorful elements are important to create my
concentration. Not just creative drawing and painting, many
combination of colors can express more thoughts and ideas
about my topic “Dreams” etc.
3. What would you say is your greatest talent or skill?
How have you developed and demonstrated that talent
over time?
Drawing&Painting&Designing
I think it’s almost the same idea as 2.
4. Describe how you have taken advantage of a
significant educational opportunity or worked to
overcome an educational barrier you have faced.
I’m not sure how to talk about this topic.
5. Describe the most significant challenge you have faced
and the steps you have taken to overcome this challenge.
How has this challenge affected your academic
achievement?
When I was in China, my parents were my time managers.
They asked me to do things in their ways. How can I grow up
with parents’ management? Sometimes I think my dad is
overprotective about my own management. I am glad my
parents gave me the chance to study in a different
environment. It is good for me to make plans with my
opinions. I am a young adult, I know how to make myself
comfortable with my high school and college life.
6. Think about an academic subject that inspires you.
Describe how you have furthered this interest inside
and/or outside of the classroom.
I’m working with my teachers in AP Art class. I think their
artworks are awesome. I am focusing on watercolor, color
pencils, and markers. Because I’m good at mixing colors into
my artworks. When I am at home, I will create my artwork
whatever I want. For example, I do not have a good mood or
I feel so emotionally unstable.
7. What have you done to make your school or your
community a better place?
My plan is keep doing what I am doing right now, try to
explore more colorful techniques to improve more creative
artworks.
Explore my knowledge about art information more etc.
8. Beyond what has already been shared in your
application, what do you believe makes you stand out as
a strong candidate for admissions to the University of
California?
Some people say that fear is the greatest motivator of human
behavior. Such as when I am going to face my challenges, I
know it’s hard to get it but I would like to try my best.
Because I want to achieve your goals. Those difficult problem
will motivate me to do it. Or I’m just afraid to fail my test, but
after the test I can start to review it and find out what I have
to improve, it motivate me to do better next time. In my point
of view, fear is my greatest motivator, because in my
mistakes I can know how to be a better person. When I have
the skill to face my fears, I can be a stronger person.
COMMON
1.Some students have a background, identity, interest, or
talent that is so meaningful they believe their application
would be incomplete without it. If this sounds like you,
then please share your story. [No change]
Art& creativity
Nobody is perfect and everybody is different, I love the way I
look and all my ideas from my artworks. I think I’m so
creative when I have my artworks. I don’t need to be the
same as others. Because I’m just the way I am! I’m glad that I
have better personality now, because I like to talk to people
about my creative ideas and express my feelings in front of
people. I think art lead my confidence to a higher level.
3.Reflect on a time when you questioned or challenged a
belief or idea. What prompted your thinking? What was
the outcome?
As a student, time management is critical. I have to balance
school schedules and leisure time. To improve time
management is write a checklist. Most of us are lazy to do
works until due day, so we get bad grade for the low quality
of work. Sometimes I have too much stuff stuck in my head, I
may forget to complete the work on time. I do not want to
start things repeatedly, it slows down the whole schedule. I
feel ok with my schedule right now because checklist helped
me a lot. I have talked to my dad about my management
through video call and also had confusion about how to
manage my finals. After our conversation, I got some tips for
the finals. During finals, I need to keep some distances from
social media, friends, and other things that may distracts me
from reviewing notes. For example, whether it is a pin-up
planner, a timetable or a calendar on my phone, find an
organizing tool that works well for me and add my list of
priorities to it. Find time for socializing, but also make sure
that get enough sleep. Most people need between 7 to 8
hours sleep every night to remain focused and alert during
study periods. Since I have more than five subjects to study, I
will organize my subjects step by step to achieve my goals. It
allows me to leave enough space for each parts. Once I go
through these stressful weeks with success, I will be free to
have as much fun as I want. Everyone has different opinions
to make checklist or plans to manage time. I think it is the
right way for me to improve my management. I hope I can be
independent without my parents’ management, because I
want to experience life by myself.
7.Share an essay on any topic of your choice. It can be
one you’ve already written, one that responds to a
different prompt, or one of your own design. [New]
I’m not a outgoing girl before, maybe I’m just shy but I don’t
know for sure. But art have changed my mind to a better
way. People think I’m cold and detached by the way I look
and the way I talk. I don’t usually express my thoughts to
people. Because I don’t know if they’re really going to care
about my ideas. I’m not talkative but I do have many creative
ideas in my mind. When I feel sad, I’ll be quiet and started
painting or drawing to relieve myself. It’s not like some
people that will shouting or hurting themselves. I’m just lost
in my own thoughts and imaginations. I know I have two
sides inside my heart: dark and light. I do believe my light
side is always more than dark side. I’m trying to be a better
girl and knowing how to control my temper.
