CIVIL PROCEDURE

Critically compare and evaluate the approach to mediation through the Civil Procedure Act 2010 and the pre-litigation requirements under the Federal Court. Is one a better model and why? Are each likely to achieve their aims? What problems do arise, or are likely to arise with each model?- AUSTRALIA

Women, leadership and international politics

In this essay, conduct a comparative analysis of an international public institution’s and an international NGO’s engagement with the topic. You can build on/expand the particular micro issue you worked on for the media analysis (media report on Angela Merkel). Your focus, however, must be transnational: not just one country and not considering issues solely as they impact on and between nation- states, but also as they impact on particular populations across national borders (e.g. indigenous populations or racial minorities, urban or rural poor, small or medium-sized businesses, women, cultural or religious communities, migrant/mobile workers and professionals, and so on), and/or political/civil society dynamics in transnational context.
You should also ensure that you do not cast your focus too broadly, but pick one or two aspects of the issue that you would like to consider: they could be (depending on your chosen issue) in the areas of politics, society, economy, environment, trade, security, armed conflict, culture, language, religion, ethnicity, human rights, and so on; they could be considered at a global or regional level, or at the level of issues that involve two or more countries in a specific relationship (e.g. cross-border cultural, trade or ethnic politics). But you need to keep your focus contained, hence the possibility of simply expanding on your topic chosen for the media analysis.

Police

You are a judge on an appellate court that has been asked to overrule the trial court in the following case. There is no dispute as to the facts.

Sixteen-year-old Chester head-butted, then slammed into the wall his six-year-old neighbor, Daisy. The boy is larger and stronger that most boys his age, but his I.Q. has been tested at 75, the low range of normal. Chester admitted the conduct but denied culpability and expressed no remorse. He claimed he was emulating what he had seen pro-wrestlers do on television.

The police charged him with juvenile delinquency, conduct which, if committed by an adult, would constitute murder. He was waived to criminal court, convicted and sentenced to death. The jury found as aggravating circumstances the facts that Chester had been in an out of juvenile court since the age of 7 on complaints of assault, robbery and sexual misconduct.
Chester’s attorney has argued: 1) that the case should not have been waived to adult court; 2) that he should not have been found guilty of murder, and 3) that he should not have been sentenced to death.
Discuss these issues with your fellow appellate judges, considering both the law and equity of the case.
